1. Service Description

TokenHub ("we", "us", "our") provides an API proxy service that routes API requests to various Chinese large language model (LLM) providers. We do not host, train, or develop AI models ourselves. TokenHub is operated from servers located in the United States (Tencent Cloud, Santa Clara, CA).

2. Acceptance of Terms

By accessing or using our service, you agree to be bound by these Terms. If you do not agree, do not use the service. You must be at least 18 years old to use this service.

3. Compliance with Laws

3.1 US Laws: You agree to comply with all applicable US federal and state laws, including but not limited to:

• DMCA (Digital Millennium Copyright Act)
• US Export Administration Regulations (EAR) - you may not use our service if you are located in or a resident of countries subject to US sanctions (North Korea, Iran, Syria, Cuba, Crimea region of Ukraine, Russia - certain restricted entities)
• FTC consumer protection regulations

3.2 Chinese Laws: Since we provide access to Chinese AI API services, you agree not to:

• Generate content that violates Chinese laws or regulations
• Generate content related to pornography, violence, terrorism, gambling, or illegal activities
• Attempt to access restricted content or bypass content filters

3.3 EU GDPR: If you are located in the European Economic Area, you acknowledge that your data may be processed on servers in the United States and transmitted to third-party AI providers in China. Do not submit personal data to our service.

4. Prohibited Uses

You may not use the service to:

• Generate illegal, harmful, or abusive content
• Infringe upon intellectual property rights
• Distribute malware, viruses, or harmful code
• Attempt to reverse-engineer the service or upstream providers
• Use automated scripts to excessively consume resources (rate limits apply)
• Resell or redistribute our API service without explicit written permission
• Violate the terms of service of any upstream model provider

5. Data Processing Disclaimer

CRITICAL NOTICE: When you use our API, your requests (including content you submit) are transmitted to third-party AI model providers located in the People's Republic of China. We do not store your prompts or responses permanently, but upstream providers may process them according to their own policies. DO NOT SUBMIT PERSONAL, CONFIDENTIAL, OR SENSITIVE INFORMATION.

6. No Warranty & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE. UPSTREAM API PROVIDERS MAY CHANGE PRICING, TERMS, OR AVAILABILITY AT ANY TIME. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.

7. DMCA Notice

If you believe content available through our service infringes your copyright, please submit a DMCA notice to: admin@loyap-innovation.com. We will respond expeditiously to valid DMCA notices and may terminate repeat infringers.

8. Termination

We reserve the right to suspend or terminate your access at any time, without refund, if you violate these terms or if upstream providers discontinue service to us.

9. Payment & Refunds

All payments are processed through third-party payment processors. Refunds are handled on a case-by-case basis within 7 days of purchase for unused balances. Abuse of the refund policy may result in account termination.

10. Changes to Terms

We may update these terms at any time. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Santa Clara County, California.
